Fox News legal analyst Judge Andrew Napolitano doesn’t believe Reality Leigh Winner is a traitor to her country. However, he does believe she committed an act of espionage.
“It’s the same espionage that some of us said Hillary Clinton committed by failure to safeguard state secrets,” Napolitano said Tuesday on Fox Business Network.
Winner, a federal contractor with the NSA, was arrested over the weekend for leaking a top secret report to a news outlet regarding information on Russian hacking efforts during the 2016 U.S. presidential election.
“To me, she’s closer to Snowden than she is to being a traitor,” Napolitano said. “She revealed a level of Russian interference with our democratic system and our incompetence in keeping the Russians out.”
Napolitano said the American people had the right to know if Russian interference substantially influenced votes on election night.
“We now know that the Russians materially and substantially attempted to affect the outcome of local state and national elections,” Napolitano said.
But, he added, “In this instance, it had nothing to do with the Trump campaign.”
An affidavit from the FBI claimed Winner had printed out the classified report on May 9 and mailed it to the online news outlet The Intercept.
“The U.S. Government Agency examined the document shared by the news outlet and determined the pages of the intelligence reporting appeared to be folded and/or creased, suggesting they had been printed and hand-carried out of a secured space,” the affidavit said.
“Winner further acknowledged that she was aware of the contents of the intelligence reporting and that she knew the contents of the reporting could be used to the injury of the United States and to the advantage of a foreign nation,” the affidavit stated.
Her motivations are not known, but WikiLeaks founder Julian Assange jumped to her aid, saying on Twitter that she needed to be protected.

The 25-year-old Winner was an avid supporter of Vermont Sen. Bernie Sanders during the Democratic primaries. She also visited former President Barack Obama in the White House in 2016.
On social media, Winner has complained numerous times about President Donald Trump. In one instance, she took on the president’s stance regarding the controversial Dakota Access Pipeline project.
“If you voted for this piece of s**t, explain this. He’s lying and the second largest supply of freshwater in the country is now at risk,” Winner wrote.
